PUBLIC HEARING, Planning & Development, Tallmadge Richmond, Planning & Development Director, Subject: Zoning Regulations Amendment [AA25-001].

Subject:  Zoning Regulations Amendment [AA25-001]

Consideration and possible approval of the proposed Amendment to the Montrose County Zoning Regulations related to Power Generation Facilities, Massage Therapy Businesses, and Natural Medicine Businesses.  In additions to the previously published potential Amendments, the following Amendments may also be considered.  

 

The following Amendments may also be considered:  

  • Section II.D.2 - Large-Scale Renewable Energy Facilities and Large Scale Solar Energy Facilities - Allowing Large-Scale Renewable Energy Facilities and Large Scale Solar Energy Facilities as Special Use in the General Agricultural District
  • Section III.D.ii - Standards and Limitations -
    • No more than 30% of property designated as prime farm ground to be used for Solar Energy Facilities unless agrovoltaics are incorporated and then no more than 50% can be used.   
    • No Solar Energy Facility shall be developed within two (2) miles of a scenic byway unless it can be demonstrated that the negative impacts of the facility can be properly mitigated.
    • The Solar Energy Facility must be located within 1,320 feet of an existing transmission line unless evidence of agreement with all landowners of property needing easements can be obtained.
  • Section III.D.iv - Securities -
    • Reclamation and Bonding - Prior to construction, the owner / operator is required to submit an irrevocable standby letter of credit, bond, or alternative form of Security in an amount of 100% of the amount sufficient to fund the estimated decommissioning / reclamation costs with the County as beneficiary.
